The following are the standard terms and conditions between Santas Agency and you, the Performer for representation by Santas Agency for all work obtained through our agency. These terms apply to all dealings between Santas Agency and you and contain the entire agreement between us regarding the matters contained herein and neither party shall be bound by any undertakings, representations, warranties, promises or the like not recorded herein. No alterations, cancellations, variation of or additions shall be of any force or effect unless reduced to writing and signed by a Director of Santas Agency.

•  Sole representation by Santas Agency (you cannot solicit christmas work through another agency)
•  You consent to the use, storage, maintenance and disclosure of your personal information
• You agree for your photographic image and profile to appear on Santas Group of Companies websites, social media and agency campaigns.
• You agree for Santas Agency Group of Companies to email information to you regarding auditions, classes and industry info.
• You consent to be filmed, photographed or recorded. You authorize for the image / recording to be used by Santas Agency for the purpose of training, use in show reels, advertising Santas Agency and Santas Academy and by doing so assign all rights to Santas.

UPDATING THESE TERMS AND CONDITIONS

Santas Agency may amend or alter these Terms and Conditions from time to time and you agree that you will be bound by such new Terms and Conditions as they are amended.

PERIOD OF REPRESENTATION

Santas Agency will actively promote and represent you as your entertainment industry agent for a period of two years (plus any additional period) from the date you join the agency or renew your registration. During this time Santas Agency will use its best endeavours to represent you for work.

SANTAS AGENCY IS YOUR AGENT

Santas Agency is your agent and represents you for work but is not your employer. Agreements for work are usually between yourself and the specific events or productions that Santas Agency manages on your behalf.

CONTRACTS FOR WORK

Most performances require the execution of a performance contract. You authorise Santas, when required, to execute such contracts on your behalf as your agent. Santas will only execute performance contracts on behalf of performers upon the performer having been advised of the major terms and the performer has confirmed their availability, and agreed to take on the booking.

FEES

Costs associated with obtaining and performing work are usually deductible against your taxable income however you should confirm this with your tax advisor. Should you decide to no longer have Santas act as your agent or if Santas cancels your registration in accordance with these terms it is not possible to refund any fees or commissions paid to or retained by Santas.

COMMISSIONS

You agree that Santas Agency may retain a commission of the gross wages earned by performer in relation to his or her employment on all amounts earned by the performer where such work was introduced or was as a result of being introduced directly or indirectly by Santas Agency. Gross wages also includes any additional payments, renewals, additional territory fees, bonuses, winnings or prizes directly or indirectly associated with such work.

PAYMENT FOR WORK

Santas Agency will only pay performers once payment has been received from the particular event or production. Santas Agency requires productions to pay within 7 days of them receiving our invoice. Santas will then pay you promptly. Please ensure Santas has correct bank account details as payments are made directly to your nominated bank account.

CANCELLING OR SUSPENDING REGISTRATION WITH SANTAS AGENCY

A performer may cancel or suspend registration with Santas by notifying Santas in writing by either mail, or email of their decision to do so.  And, if suspending, state the period required. Santas Agency may cancel registration of a performer if we believe the performer has committed misconduct in relation to work. This may include a performer not attending work when booked without advising our team or client or failing to attend work when booked without reasonable excuse. We may suspend your registration if we cannot get in contact with you via the telephone numbers you have provided. It is your responsibility to notify us of changes.  Santas Agency may cancel representation if the Performer has remained suspended for longer than12 months.

AGENCY OVERVIEW

Santas Agency operates as a talent agency and represents and promotes performers for work in various productions. Performers are usually submitted to casting agents or casting directors or directly to our clients. that 

Our agency then put's forward talent that we think suit the descriptions the casting agents/directors or our clients have given. 

Once confirmed,we then contact the relevant performers to book. 

DEFINITIONS

TalentAgent - A person or business that represents performers for work in film, television, entertainment and event industies. In this case Santas Agency.

Casting Agent/Casting Director - A person or business that works on behalf of a production or event to cast the required roles of the particular production. Casting agents/directors invariably use Talent Agents to provide talent to fill roles.

Client- a person or company who pays a professional person or organization for services. Our clients come back year after year- to use Santas casting and agency services to book talent for their event, promotion or Christmas season.

Call Time - The time you are required at the specified location and ready to take direction. You should arrive at least 20-30 minutes prior to your call time to ensure you are ready.

Wardrobe - Prior to commencing the production you may be required for wardrobe fitting, this may happen at any time prior to the performing days. If you are required to attend for wardrobe you will be paid as per MEAA guidelines. 

What happens after I apply to Santas Agency? 

We read all applications and put them on file. Unfortuantely we can’t reply to every application. If you are in an area we require a Santa Claus, and your applicaiton is great, you will receive an email or a phone call to discuss an interview. 

What’s a WWC? 

A WWC is a working with children check. They are called different names in different states such as working with vunerable people, national child check, or bluecard. 

Do I need a WWC?

You do not need a WWC to apply to one of our courses or to be considered for representation, but you must hold one to be offered any bookings. This is a legal requirement. 

Do I need a costume?

Santas Agency has professional Santa Claus, Mrs Claus and Elfe costumes and attire to loan with our bookings. Costumes are on loan and must be looked after and returned when required. Some Santas prefer to invest in their own costume which is also fine as long as approved by Santas Agency. 

What sort of jobs might I do?

Santas Agency takes bookings across South Australia and is always expanding to new locations nationally. The talent we represent could be hired across a number of positions or locations including shopping centres, child care centres, schools, corporate events, private visits and photography. You will be offered jobs based on your suitability, and preference. 

Will I be paid?

All professional Christmas positions are paid. You are paid based on the position, the number of hours booked, your experience, and the actual job. Exact remuneration is discussed on every booking.
